Artwork Purchase, Commission & Preorder Terms
SECTION 1 - Payment & Deposits
For purchases of completed original artworks, payment terms will be confirmed at the time of purchase. Full payment must be received before the artwork is released for collection or delivery.
For commissions and preorders, a 50% deposit is required to confirm the order and secure its place in Farah’s painting schedule. The remaining 50% balance is due upon completion of the artwork and must be settled before collection or delivery.
Once work on a commission or preorder has commenced, the deposit is non-refundable.
If a commission or preorder is cancelled before work has commenced, any costs already incurred specifically for the artwork, including special materials where applicable, may be deducted from any refund due.
SECTION 2 - Artistic Interpretation & Variations
This section applies to commissions and preorders.
Each commissioned or preordered artwork is individually created as an original Farah Omar artwork and is not intended to be an exact reproduction of any existing piece.
For commissions, agreed preferences such as size and overall colour palette will guide the work, while composition, brushwork, texture, colour interpretation and final artistic decisions remain at Farah’s creative discretion.
For preorders, the artwork will retain the spirit and artistic direction of the selected piece while developing its own unique character. Variations between the original inspiration and the completed artwork are a natural part of the creative process.
SECTION 3 - Changes & Revisions
This section applies to commissions and preorders.
For commissions, the agreed size and overall colour direction will be confirmed before work begins. Once painting has commenced, changes are generally not permitted, allowing the artwork to develop naturally through Farah’s artistic process.
Upon completion, minor adjustments may be considered at Farah’s discretion where reasonably possible. Substantial changes or requests that alter the agreed direction may incur an additional charge.
Preordered artworks are created as new original interpretations of the selected work and are not subject to revisions.
SECTION 4 - Timeline & Completion
This section applies to commissions and preorders.
An estimated completion timeframe will be provided when the commission or preorder is confirmed. This timeframe is an estimate and not a guaranteed completion date, as the creative process, drying time and finishing requirements may vary between artworks.
Should a significant delay arise, the collector will be informed and an updated estimated completion timeframe will be provided.
SECTION 5 - Cancellation
Completed Original Artwork Purchases
Once payment has been made for a completed original artwork, the purchase is considered final and cannot be cancelled or refunded for a change of mind.
This does not affect any rights or remedies available under applicable law or in relation to artwork received damaged, as addressed under Section 8.
Commissions & Preorders
If a commission or preorder is cancelled before work has commenced, the deposit may be refunded less any costs already incurred specifically for the artwork.
Once work on the artwork has commenced, the 50% deposit is non-refundable. If the collector chooses to cancel after this point, the remaining balance will not be due.
SECTION 6 - Collection, Delivery & Shipping
Complimentary standard delivery is available within the Klang Valley, subject to the size and handling requirements of the artwork.
Complimentary delivery may also be available for unstretched artworks shipped rolled, where the artwork falls within standard delivery specifications.
Large, stretched, framed or specially handled artworks may require additional delivery or shipping arrangements, which will be quoted separately where applicable.
For deliveries outside these arrangements, shipping costs will be quoted separately.
The artwork will be released for collection or delivery once the outstanding balance and any applicable delivery or shipping charges have been settled.
For international orders, any applicable customs duties, taxes or import charges are the responsibility of the collector.
Delivery Insurance
Where appropriate, insurance for the artwork during transit may be arranged and quoted separately. Any applicable insurance cost will be confirmed with the collector before shipping.
For higher-value, international or specially handled artworks, insured delivery may be required by Farah Omar Art as a condition of shipment.
SECTION 7 - Ownership & Copyright
Ownership of the physical artwork transfers to the collector once payment has been received in full.
Copyright and reproduction rights remain with Farah Omar. This includes the right to photograph and reproduce images of the artwork for purposes including the artist’s portfolio, website, social media, publications, exhibitions, prints and other artist-authorised reproductions.
Purchase of an artwork does not transfer copyright or commercial reproduction rights to the collector. The artwork may not be reproduced, used commercially or used to create prints, merchandise or other reproductions without prior written permission from Farah Omar.
If a commission or preorder is cancelled before completion, the unfinished artwork remains the property of Farah Omar, together with all copyright and reproduction rights.
SECTION 8 - Returns, Refunds & Damage
All completed artwork purchases, commissions and preorders are considered final once payment has been completed. Refunds are not provided for a change of mind.
If an artwork arrives damaged, the collector should notify Farah Omar Art promptly upon receipt and provide photographs of the artwork and packaging so the matter can be assessed.
Once an artwork has been received in good condition, Farah Omar Art is not responsible for subsequent loss or damage resulting from handling, installation, storage, transportation, environmental conditions, accidents or other circumstances occurring after delivery or collection.
Any remedy for artwork damaged during delivery will be assessed based on the circumstances of the delivery, the agreed courier, shipping and insurance arrangements, and applicable consumer law.
SECTION 9 - Artist Inability to Complete
This section applies to commissions and preorders.
In the unlikely event that Farah Omar Art is unable to complete a commission or preorder due to unforeseen circumstances, the collector will be informed as soon as reasonably possible.
Where the artwork cannot be completed, any payments received for the uncompleted artwork will be refunded to the collector.
Farah Omar Art will not be responsible for additional costs or losses arising from the cancellation.
SECTION 10 - Framing
Framing is not included in the artwork price unless specifically stated in the artwork listing or agreed otherwise. Where framing is requested, available options and any additional costs will be discussed and confirmed with the collector before proceeding.
SECTION 11 - Acceptance of Terms
By confirming an artwork purchase, commission or preorder, the collector acknowledges and agrees to these Artwork Purchase, Commission & Preorder Terms. These terms apply subject to any rights or protections that cannot be excluded under applicable law.
